Sean “Diddy” Combs has requested a Manhattan federal judge to release him on time served ahead of his scheduled sentencing on October 3.

The 55-year-old music mogul has been incarcerated at the Metropolitan Detention Center in Brooklyn since his arrest in September 2024. His legal team argues that the over 13 months he has already served, combined with the severe impact on his career and reputation, warrant his immediate release.

Combs was convicted in July 2025 on two counts under the Mann Act for transporting individuals across state lines for prostitution. Each count carries a maximum sentence of 10 years in prison. However, he was acquitted of more serious charges, including sex trafficking and racketeering conspiracy.

In their filing, Combs’ attorneys highlighted his efforts towards rehabilitation during his incarceration, noting his participation in substance abuse treatment and educational programs. They also emphasized the personal toll the case has taken on him, including the dissolution of business ventures and strained family relationships.

Prosecutors are expected to recommend a sentence longer than the 14 months proposed by the defense. They argue that a substantial prison term is warranted given the nature of the offenses and the harm caused to the victims involved.
