In a dramatic and controversial move, the Federal High Court in Abuja has referred Mazi Nnamdi Kanu, the leader of the Indigenous People of Biafra’s urgent motion for medical transfer to the Chief Judge for reassignment, raising fresh concerns over the ill-treatment of the IPOB leader while in the DSS custody.

The motion, dated September 1, 2025, sought to transfer Kanu to the Abuja National Hospital for immediate medical attention.

Court documents indicate that Kanu suffers from serious health complications, including pancreatic issues, liver dysfunction, and dangerously low potassium levels, all of which have worsened due to prolonged solitary confinement.

Legal experts and human rights advocates warn that his health could deteriorate further if he remains in detention without proper care.

Mazi Nnamdi Kanu’s lawyer Mr. Kanu Agabi SAN said that a letter by the doctors to the director-general of the SSS, advising the transfer of Kanu had gone without answer.

Justice Musa Liman, presiding over the matter during the court’s vacation, acknowledged the urgency of Kanu’s condition but cited the pending court docket and limited time remaining in vacation as reasons for not hearing the application.

He consequently referred the motion back to the Chief Judge for reassignment, sparking criticism from observers who see this as yet another delay in an unnecessary case that has dragged on for years.

According to Kanu’s legal team, who emphasized that the repeated delays are exacerbating his medical condition. Every day that passes in detention without proper treatment is a direct threat to his life, his lawyer told reporters.

The Department of State Services (DSS), represented by Chief Adegboyega Awomolo, SAN, countered the motion, filling 37 paragraph affidavit opposing the application of Mazi Nnamdi Kanu’s lawyers for him to be transferred to general hospital for proper medical treatment.

Public criticism has mounted over what many describe as the unnecessary and deliberate prolonging of Kanu’s trial.

Commentators argue that the excessive legal proceedings appear to be a waste of time, especially as Kanu has no substantive case to answer, making the delays particularly indefensible in light of his worsening health.

This latest development follows a series of judicial maneuvers in Kanu’s case. Earlier this year, the Chief Judge reassigned his trial after Justice Binta Nyako recused herself following allegations of bias.

Kanu’s supporters and civil rights organizations have repeatedly condemned the process as protracted and punitive, rather than procedural, calling for his urgent release on medical grounds.

As the Chief Judge considers the reassignment, the eyes of the nation and international observers remain fixed on Abuja, with Kanu’s health hanging in the balance and public outrage over the delays intensifying.
